Pursuant to Article 13 of the GDPR, we hereby inform you about the rules for processing personal data by us.
§ 1 Controller
- The Controller of personal data remains Fabryka Atrakcji - hereinafter referred to as: Controller.
- The Controller has not appointed a Data Protection Officer.

§ 2 Scope of processed personal data
- the Controller processes personal data belonging to the category of ordinary personal data and these are: first name, last name, telephone number, email address.
- in the case of data obtained by the Controller in a way other than directly from the person to whom they relate, the Controller processes personal data classified as so-called ordinary personal data, referred to in point 1).
§ 3 Purpose and basis for processing
- for preparing an offer to conclude an agreement, taking up cooperation or responding to an offer to conclude an agreement submitted by you (Article 6(1)(b) GDPR)
- for the purpose necessary for the proper performance of the agreement, contact in connection with the performance of the agreement (Article 6(1)(a) or (b) GDPR),
- for considering your complaints, objections regarding the method of service provision, responding to notifications submitted by you regarding the agreement or the service provided (Article 6(1)(c) GDPR),
- for performing obligations incumbent on the Controller resulting from generally applicable law, including tax law, administrative law (Article 6(1)(c) GDPR),
- for pursuing claims or protecting against claims arising from concluded agreements and provided services (Article 6(1)(f) GDPR).
- based on the Controller's legitimate interest, i.e. providing answers to questions sent through the tab, for statistical purposes and research of activity on our social media profiles (Article 6(1)(f) GDPR),
- based on your consent, in particular for marketing purposes (Article 6(1)(a) GDPR).
§ 4 Obligation to provide personal data, rules for their disclosure
- Providing us with your personal data is not mandatory. Providing this data is necessary for the proper implementation of services, agreements, taking up cooperation, considering complaints or claims
- in some cases, when processing of personal data is related to the performance by the Controller of obligations resulting from generally applicable law, providing personal data is a legal requirement.
- personal data are transferred to specific recipients of these data to which include: entities cooperating with the Controller in the provision of services to it, in particular notary, accounting, legal, insurance, auditing, debt collection, postal services and other entities providing legal services independently deciding on the purposes and methods of data processing;
- public authorities and institutions on the principles resulting from generally applicable law, including judicial authorities and courts, tax authorities are authorized to obtain these personal data.
§ 5 Period of storing personal data
- personal data should be stored no longer than necessary for the purposes for which they are processed, e.g. for the period of duration and implementation of the agreement and for the period in which claims are possible;
- time related to obligations imposed on the Controller by generally applicable law to archive personal data related, for example, to tax regulations, for example, for 5 years from the end of the calendar year in which the tax payment deadline expired;
- if personal data are processed on the basis of consent, they will be processed only until this consent is withdrawn;
§ 6 Rights related to processing personal data
- the person whose data are processed is entitled to the following rights in the scope of processing personal data:
- right to access your personal data
- right to request access to personal data from the Controller,
- right to request rectification, deletion of personal data,
- right to request restriction of processing of personal data,
- right to data portability.
- you also have the right to object to the processing of personal data for reasons related to your particular situation. Filing an objection will result in us ceasing further processing of these data, unless their processing will be necessary due to the existence of legally justified grounds existing on the Controller's side or grounds for pursuing claims or defending against them. The right to object applies in particular to data processed in connection with the Controller's legitimate interest, i.e. based on Article 6(1)(f) GDPR.
- we also inform that you are entitled to submit a complaint to the competent supervisory authority – President of the Personal Data Protection Office.
- considering that we process your personal data based on your consent to their processing, in this respect you have the right to withdraw consent at any time without affecting the lawfulness of processing carried out on the basis of consent before its withdrawal.
§ 7 Information regarding the use of cookies
- we inform that personal data are not transferred by us to third countries, nor to international organizations within the meaning of the GDPR. However, we indicate that in connection with the cross-border nature of social media services, they may transfer your data outside the European Economic Area. - The Controller does not apply automated processing of personal data, including profiling.
- this document will be updated by the Controller in every case when there will be a change concerning the information contained therein.
INFORMATION REGARDING THE RULES FOR USING COOKIES
- our website uses Cookies. Cookies (so-called cookies) are small text files, stored on the device from which you use when browsing our website.
